Terms of business


1. Unless otherwise expressly agreed in writing by the Company (airmaxxevents) no services shall be supplied by the Company to the Hirer except in accordance with these conditions, which supersede any earlier sets of conditions appearing in the Companies catalogues or elsewhere. The conditions shall constitute the entire terms and conditions of the contract between the Company and the Hirer and, in the event of any conflict, these conditions stipulated incorporated or referred to by the Hirer whether in the order or in any negotiations or otherwise.


2. Prices quoted by the Company to the Hirer will be maintained for a period of 30 days from the date of commencement of the contract.


3. All equipment whether hired with or without a supervisor, must be supervised by a person over the age of 16.


4. Any person who is visibly intoxicated through alcohol, drugs or any other intoxicating substance shall not be allowed to use the equipment.


5. No food (including gum) or drink shall be allowed in or on any item of equipment.


6. No equipment shall be used outdoors during bad weather particularly strong winds.


7. All electrical equipment and generators must be switched off during re-fuelling. Re-fuelling containers must be suitably marked and kept in a safe location.


8. All equipment requiring anchoring must not be used until the equipment has been suitably anchored.


9. All persons using inflatable equipment must remove their footwear.


10. When hiring the Bungee Run - Users of the equipment must not be stretched along the bungee by another party Socks must be worn by all participants whilst using the equipment. Bungee Ropes must not be altered in any way


11. Any time or date named by the Hirer for delivery of the services is given as a forecast in the light of prevailing conditions and is given and intended as an estimate only. If notwithstanding the Companies best endeavours the Company fails to perform the services on the agreed date, such failure shall not constitute a breach of the contract and the Company shall not be liable to the Hirer to make good any damage or loss whatsoever whether arising directly or indirectly out of any delay in performing such services.


12. The Hirer undertakes to ensure an RCD protected 13 amp mains supply is available within the set up area and that access to the set up area and the set up area itself is adequate for the equipment hired. If the required power source is not available then the Hirer agrees to pay the Company the additional costs of providing a generator.


13. The Hirer confirms that no-one over the age of 14 shall be permitted to use bouncy castles and inflatables. This does not apply to bouncy castles and inflatables, which are manufactured and designed for adult use. The Hirer also confirms that no one under the influence of alcohol or drugs shall use the equipment supplied.


14. Save in respect of death or personal injury arising from the negligence of the Company, the Company shall not be liable for any claim or claims for direct or indirect consequential or incidental injury, loss or damage made by the Hirer against the Company whether in contract or tort (including negligence on the part of the Company, its servants or agents) arising out of or in connection with any act, omission, neglect or default (whether or not the same constitutes a fundamental breach of contract or breach of a fundamental term thereof) of the Company, its servants or agents in the performance of this contract. If the Company is found to be liable or admits liability the liability

should be limited to the value of the invoice to which the claim relates.


15. All accounts are payable on demand. In the absence of demand, the Hirer shall make payment in full for the services provided in cash to the Company upon delivery of the service. Cheques will only be accepted if paid and cleared prior to delivery of the service. Furthermore, the Company shall be entitled to charge interest at the rate of 2.5% per month upon all overdue balances. The Company shall also be entitled to charge such reasonable costs as it may incur in recovering any overdue balances.


16. The time within the Hirer is to pay for the services shall be of the essence in this contract and in the event that the Hirer shall fail to make payment by the due date, all sums due to the Company from the Hirer under this or any other contract for the supply of services shall forthwith become due and payable to the Company.


17. The Company retains a general lien on any of the Hirer's equipment or other goods in the Companies possession for any unpaid balance the Hirer may owe to the Company.


18. The Hirer is liable financially for any loss or damage to the equipment.


19. The Hirer must advise the company of the location of any underground services on the site where the equipment is to be set up.


20. The Company shall not be liable in respect of conditions or warranties whether expressed or implied, that have not been confirmed by them in writing. The Company shall not be liable in respect of consequential loss.


21. Upon confirming this booking, cancellations for any reason are charged at 50% of the total booking costs up to 7 days prior to the event. Cancellations for any reason received within 7 days of the of the event date, cancellation charges are charged at 100% of the total booking costs. All cancellation charges are payable at time of cancellation. This also refers to cancellations resulting in adverse weather or unsuitable set up conditions. By employing our services, you are not automatically entitled to a cooling off period under Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 - Catering and Leisure Supplies for a time specific date. Cancellations can only be accepted in writing from the hirer, please send cancellations to: info@AirMaxxEvents.co.uk.


22. This contract shall be governed by English Law and the parties hereto shall submit to the sole jurisdiction of the English Courts.


23. AirMaxx can handle 100's of deliveries per day. With many unforeseeable contributing factors including delivery delays, road works and vehicle failure, though unlikely, you may experience a delay in your delivery. Delivery times are not guaranteed though we will try our utmost to deliver your goods in a timely and consistent manner. For the sake of good order, your delivery can take place at anytime from ''The equipment shall be delivered from'' to the ''The equipment shall be used from'' times as indicated on your booking confirmation unless prior arrangements have been made beforehand. We understand that delays can be both frustrating and disappointing and in such circumstances, the following late compensation policy will apply: 25-60 minutes after the indicated ''used from'' time: 10% of the hire price will be compensated (capped at £150.00) 61-120 minutes after the indicated ''used from'' time: 15% of the hire price will be compensated (capped at £175.00) 121+ minutes after the indicated ''used from'' time: 25% of the hire price will be compensated (capped at £200.00) Compensation reimbursements will be issued from the registered office on the next working day after the delivery has taken place, not on delivery of the goods from your driver. Reimbursements will be made by either BACs for all bank, cheque and cash payments and debit/credit card reimbursements will be issued directly back to the debit/credit card used at the time of the order. Late penalties will be calculated using the company vehicle tracking system working on real time updates. Should you choose to refuse a late delivery, for reasons outside of our control, full payment will be required. However, AirMaxx Events does not have to pay compensation if the delay was caused by a situation beyond its control or if the item was not ordered correctly. Examples where AirMaxx Events would not have to pay compensation include: Severe weather conditions preventing the installation of the equipment safely Acts of terrorism There is an error/change on the booking form that the hirer has not signed off on the booking agreement Major traffic delays or a severe state of emergency It is expressively recommended that an hour is allocated for both delivery and collection of your goods (additional time required for multiple items delivered). Even though it is likely that the equipment ordered may take less time to install than this recommended time, affording this recommendation will ensure that in the event of an unforeseen delivery delay occurs, this will not adversely effect your event. Should you choose not to afford this recommendation, AirMaxx Events can not be held responsible for unforeseen delays effecting your event.


24. Where required, we will require sufficient parking for our vehicle. This will include time taken to load/unload. In the event AirMaxx are providing supervisory staff or operative staff, parking provisions may be required for the duration of the event.
